These Terms of Service apply to the supply of goods through the Letter to Me online store (“Letter to Me”, “we”, “our”, or “us”). By accessing our website and/or placing an order with us, you agree to be bound by these Terms of Service and any additional policies referenced here (including our Returns Policy) that are available on the Site.

If you do not accept these Terms of Service in full, you do not have permission to access the contents of this website and should cease using it immediately.

Our store is hosted on WooCommerce, which provides the e-commerce platform that allows us to sell our products and services to you.

1) Site Access and Changes

Our website changes regularly and access to this site is permitted on a temporary basis. We aim to update the Site regularly and may change content at any time, including product details, availability, and pricing, without notice.

We may suspend access to the Site, or close it indefinitely, if the need arises. Any material on our Site may be out of date at any time and we are under no obligation to update such material.

You are responsible for ensuring that all persons who access our Site through your internet connection are aware of these Terms of Service and that they comply with them.

 

2) Changes to These Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms of Service.

 

3) Products and Jewellery Care

We take care to ensure our product descriptions and images are accurate. However, minor variations can occur due to lighting, screen display settings, and natural variation in materials and finishes.

Many items are made from 925 sterling silver unless stated otherwise. Sterling silver may naturally tarnish/oxidise over time; this is normal and often reversible with proper care. Damage caused by improper care, exposure to chemicals (including perfumes, lotions, cleaning products), swimming, impact, or excessive wear is not considered a manufacturing fault.

 

4) Contract Formation

No contract will exist between you and Letter to Me for the sale of any product unless and until we accept your order by sending an order confirmation and receiving full payment (including through a payment provider). Our acceptance of your order brings into existence a legally binding contract between us.

By placing an order, you confirm that you are at least 18 years old (or otherwise legally able to enter into a binding contract in your jurisdiction).

Our right to refuse or cancel orders

Letter to Me reserves the right not to accept or to cancel your order if:

    • we are unable to obtain authorisation for payment;
    • shipping restrictions apply to a particular item or destination;
    • the item ordered is out of stock, withdrawn, or fails quality control;
    • there is an error in pricing, product description, or content; or
    • we reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been taken, we will refund the amount paid for the goods.

 

5) Pricing, Currency, Taxes, and Duties

Currency

Prices are displayed in NZD (New Zealand Dollars) by default.

We may also display prices in AUD, GBP, or USD based on your location or selected settings. If shown in a currency other than NZD, currency conversion is an estimate and may vary due to exchange rate changes, rounding, card issuer rates, or payment provider fees.

GST and tax

Prices may be inclusive of NZ GST where applicable. Any taxes applied will be shown at checkout where possible.

International duties/taxes

For deliveries outside New Zealand, customs duties, import taxes, and fees may be charged by your local authorities and are the customer’s responsibility unless we explicitly state otherwise.

6) Payment

By purchasing on this Site you confirm that the payment method used is yours or that you have been authorised by the owner to use it.

All cardholders are subject to validation checks and authorisation by the card issuer. If the issuer refuses to authorise payment, we will not be liable for any delay or non-delivery.

Payment methods available will be shown at checkout and may include credit/debit card, Vias card, Master card and any other methods we advertise on the Site.

 

7) Shipping and Delivery

We ship to the address you provide at checkout. You are responsible for ensuring your address details are correct and complete.

Processing times and shipping estimates will be shown on the Site and/or at checkout. Delivery times are estimates only and may be impacted by carrier delays, customs processing, or events outside our control.

If a parcel is delayed, missing, or damaged in transit, please contact us at lettertome.nz@gmail.com and we will assist you in line with the carrier’s processes and any applicable consumer law.

 

8) Order Cancellation

If you need to cancel an order, please email lettertome.nz@gmail.com as soon as possible with the subject line “Cancellation”, including your order number.

If your order has not yet been dispatched, we will do our best to cancel it. If it has already been dispatched, your order will be subject to our Returns policy below.

 

9) Returns, Refunds and Exchanges (14-Day Policy)

We understand that when shopping online, you are unable to see or try on your jewellery in person. For this reason, we offer a 14-day refund policy so you can feel confident in your purchase. If for any reason you are not completely satisfied, Letter to Me will provide a refund for items returned unworn, in perfect condition, and in their original packaging within 14 days of receiving your order. Refunds are not available for change-of-mind returns received after 14 days from the date of delivery.

Items not eligible for change-of-mind returns

The following items are exempt from refund or exchange for change-of-mind reasons, unless found to be faulty (or otherwise required by law):

    • Earrings (for hygiene reasons)

    • Customised pieces

    • Promotional or sale jewellery

Faulty items (New Zealand — Consumer Guarantees Act)

Nothing in this policy limits or replaces your rights under the Consumer Guarantees Act 1993 (New Zealand). Where goods are faulty or do not comply with the Act, you are entitled to a remedy in accordance with the Act (which may include repair, replacement, or refund depending on the circumstances).

If you believe your item is faulty, please contact us as soon as reasonably possible after noticing the issue, with your order number and clear photos where you can. Once notified, we will confirm the next steps and return process in writing.

Note: Sterling silver may naturally tarnish/oxidise over time. Tarnishing due to normal wear, exposure to air/moisture, perfumes, lotions, cleaning chemicals, swimming, or improper storage is not necessarily a fault.

Returns shipping and responsibility

Items remain your responsibility until they reach us. We cannot be held liable for returns lost or damaged in transit. We strongly recommend using a secure, trackable delivery service that requires a signature upon receipt.

Unless the item is confirmed to be faulty (or we have otherwise agreed in writing), return shipping costs are the responsibility of the customer and are non-refundable.


 

10) Processing Your Refund

Upon receipt and inspection of the returned items, the original payment method used for the purchase will be credited with the cost of the goods, minus any original delivery charges (exceptions may apply).

If your order originally qualified for free shipping and the return causes the remaining order value to fall below the free shipping threshold, the applicable standard shipping fee will be deducted from the refund amount.

We aim to process refunds within 48 hours of receiving the returned goods. Please note that your bank or card provider may take up to 7 working days to reflect the refund in your account.

 

11) Warranty (New Zealand — Consumer Guarantees Act 1993)

If you are a consumer in New Zealand, our goods come with automatic guarantees that cannot be excluded under the Consumer Guarantees Act 1993. This includes guarantees (where applicable) that products will be of acceptable quality, fit for purpose, and match their description.

Where a product fails to meet a guarantee, you may be entitled to a remedy under the Act (repair, replacement, or refund depending on the circumstances, including whether the failure is substantial). Our store policies are offered in addition to your rights under New Zealand consumer law.

 

12) Promotional Samples (If Applicable)

Product samples lent by Letter to Me for promotional material, editorial use, photography, or any other reason may be charged in full if not returned in perfect condition. Unless otherwise agreed in writing, samples must be returned within 7 working days from the day of receipt.

 

13) Intellectual Property

The entire content of this website, including all jewellery designs, photographs, logo, copyright, trademarks, and other intellectual property rights (including the use of the name Letter to Me) is the property of Letter to Me.

You may store, print, and display content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute, or otherwise reproduce any content from this website in any format for commercial purposes without our prior written consent.

 

14) User Content (Reviews, Photos, Submissions)

If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for marketing and business purposes (unless prohibited by law). You agree not to post unlawful, abusive, or infringing content.

 

15) Liability and Disclaimers

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available”. Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under New Zealand law (including the Consumer Guarantees Act 1993) or any other applicable consumer protection laws.

To the extent permitted by law, we will not be liable for indirect or consequential loss arising from your use of the Site or purchase of goods from us.

Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

16) Entire Agreement

These Terms of Service set out the entire agreement between you and Letter to Me in respect of the sale, purchase, and use of the goods and the Site. They supersede any prior agreement or understanding relating to the same subject matter. No variation is binding unless agreed by us in writing.

 

17) Governing Law

These Terms of Service are governed by the laws of New Zealand, together with any applicable consumer protection laws. Where permitted, disputes are subject to the non-exclusive jurisdiction of New Zealand courts.
